Third Circuit clears up confusion over "receipt" in administrative expense claims
A US appeals court has clarified the process for recovering the value of goods shipped to a debtor from overseas immediately prior to bankruptcy, ruling that "receipt" of goods in the context of an administrative expense claim under US Bankruptcy Code requires taking physical possession.
