Dr Eric Levenstein has been a director at Werksmans Attorneys since 1993. Based in Johannesburg, Eric is the head of the firm’s insolvency, business rescue and restructuring practice group. Eric has been very involved in the development of the new business rescue legislation (Chapter 6 of the 2008 Companies Act) since it became part of South African law in 2011. He has regularly researched and contributed to the development of this area of law, having submitted various legal briefs, journal articles, reports in the media and on radio and television on the subject. He has also given numerous presentations at various forums and seminars on these issues, including the law on director liability.Eric’s research culminated in his being awarded a Doctorate in Laws (LLD) on the topic of business rescue from the University of Pretoria in 2016. Eric has also authored the book South African Business Rescue Procedure (LexisNexis) in 2017.Eric has acted in various high-profile business rescue matters including Pearl Valley Golf Estate, Southgold Exploration, Ellerines, Advanced Technologies & Engineering, Meltz Success, On-Digital Media (Top Tv), Moyo Restaurants, Optimum Coal Mine and Stuttafords. He has been recognised as a leading insolvency and restructuring lawyer in restructuring/insolvency by Chambers Global (2017 and 2018 – Band 1) and in Who’s Who Legal (2014, 2016, 2017 and 2018). He has also been recognised as a highly recommended lawyer in dispute resolution (business rescue) by The Legal 500 (2012–2017). Eric sits as a National Board member of The South African Restructuring and Insolvency Practitioners Association (SARIPA) and is a member of INSOL International, where he serves as chairman of the INSOL Small Practice Membership Issues Committee (2017–2019). Eric also holds a BCom, LLB, higher diplomas in company law and tax and a diploma in insolvency law.
