US Supreme Court makes landmark safe harbour ruling
The US Supreme Court has barred defendants that are not financial institutions or market participants from invoking the US bankruptcy code’s “safe harbour” clawback, even where a qualifying entity has been an intermediary in an allegedly fraudulent transfer.
