Seventh Circuit decision on safe harbour deepens US split
A US appeals court has diverged from numerous earlier rulings to deepen a split between the circuits, by finding that the US Bankruptcy Code’s safe harbour provision does not protect transfers where a qualifying financial institution acts merely as a conduit.
