Ninth Circuit decision lets unimpaired creditors receive higher post-petition interest

In what has been hailed as a much-anticipated decision that could eventually lead to a split in the circuits, a US appeals court has found that unimpaired creditors of a solvent Chapter 11 debtor are entitled to a higher rate of post-petition interest than the US federal judgment rate.
