Hong Kong court dismisses winding-up petition in favour of arbitration

In a ruling that has moved Hong Kong closer in line with England and Singapore, the High Court of Hong Kong has concluded that where a disputed debt is subject to an arbitration agreement, winding-up petitions should be dismissed without the need to establish a “bona fide defence on substantial grounds”.
