European court finds EIR rules on COMI apply to liquidated developer’s tort claim against creditors
The European Court of Justice has ruled that Austrian courts were right to reject lawsuits filed by a Slovakian property developer that was wound up after its creditors vetoed a restructuring plan, because the cases were outside their jurisdiction under EU cross-border insolvency rules.
