Cox Operating: legal finance as a tool for generating liquidity in bankruptcy
Burford managing director Emily Slater and vice president Charles Griffin discuss the recent Chapter 11 restructuring of oil producer Cox Operating, which included a novel section 363 auction to monetise a pre-filing litigation. They say the case has created a “roadmap” for bankrupt companies with significant litigation assets to generate substantial value for the debtor and its creditors.
